These Terms are between Peak13 Potential Ltd, trading as GaryDoesStrategy (company number 15734692, registered office 50 Princes Street, Ipswich, Suffolk, IP1 1RJ, England & Wales), referred to as "we" or "us", and the business asking us to provide Services, referred to as "you".

1. Basis of agreement

A contract is formed when you accept our written quote, including by email. These Terms apply to every project and take priority over your own standard terms, unless we've agreed a change with you in writing.

These Terms are for business services. If you are hiring us as a private individual rather than for a business, tell us before you accept a quote.

2. The Services

We offer the following, as described on this website when you accept a quote:

The exact scope, price and timeline for your project are whatever our written quote says.

3. The free website review

The review is free and you have no obligation to hire us. It is our opinion on what to improve on your site. It is not a guarantee of results, and you decide what to act on.

4. Fees and payment

Fees are as set out in your quote, plus VAT where it applies. Website, landing page and app projects are invoiced on the schedule in your quote, usually a deposit before work starts and the balance before launch. Care plans are invoiced monthly in advance.

Invoices are payable within 14 days. If a payment is late, we may charge interest at 4% above the Bank of England base rate, and we may pause work until it is paid.

5. Your part

To keep a project on time, you agree to send the content, logins and feedback we ask for. If a project is on hold for more than 30 days because we are waiting on you, we may invoice the work done so far.

6. Changes

Your quote sets out the rounds of changes included. We'll quote any extra work before we do it.

7. Hosting, domains and third parties

Hosting, domain names, plugins and other third-party services are provided under their own providers' terms. We are not responsible for outages or changes made by those providers.

8. Care plans

Care plans run month to month. Either side can cancel with 30 days' written notice. A plan covers the work listed in it, and we quote bigger changes separately.

9. Ownership

Once you have paid in full, you own the design and content we create for your project. We keep ownership of our general tools, code and methods, and we give you a permanent licence to use them as part of your site or app. Stock images, fonts and third-party software stay under their own licences.

We may show the finished work in our portfolio, unless you ask us in writing not to.

10. Confidentiality

We won't use or share information about your business except to do the work, or where the law requires it. You'll keep confidential anything we tell you about our own business or methods. Neither duty applies to information that is already public.

11. Data protection

We handle personal data in line with our Privacy Policy. If a project involves us processing personal data on your behalf, we agree those terms with you separately before we start.

12. Liability

We are not liable for indirect or consequential loss. Our total liability for any project is capped at the fees you paid us in the 12 months before the claim. This cap does not apply to death or personal injury caused by our negligence, to fraud, or to anything else the law doesn't allow us to limit.

13. Ending a project

Either side may end a project if the other seriously breaks these Terms and doesn't put it right within 14 days of being told. We may also end a project if an invoice goes unpaid or you become insolvent. In every case, you pay for the work done up to that point.

14. Using this website

The content on this site is general information, not professional advice for your business. Please don't copy it for your own use without asking us first.

15. General

If any part of these Terms can't be enforced, the rest still applies. We may update these Terms, but not the price of a project already agreed. The current version is always the one published on this page. These Terms are governed by English law, and the English courts have exclusive jurisdiction.
